La SCI familiale offre une gestion beaucoup plus souple que l’indivision, qui peut parfois aboutir à des blocages. Elle offre aussi des avantages sur le plan fiscal. C’est donc un outil efficace. Mais la fiscalité ne doit pas être la seule raison de créer une SCI car la prise en considération de la situation familiale, l’aspect humain du projet, est tout aussi importante. Une SCI permet à plusieurs personnes (les associés), d’être propriétaires et de gérer ensemble un ou plusieurs biens immobiliers. Il n’est pas obligatoire que les associés soient propriétaires dans les mêmes proportions. En revanche, une formalité est obligatoire : rédiger les statuts, véritable contrat écrit qui va organiser le fonctionnement de la SCI. Ces statuts peuvent être rédigés par les associés eux-mêmes (acte sous seing privé) ou par un notaire. Le recours au notaire est obligatoire lorsque lorsque le ou les biens immobiliers sont apportés à la SCI au moment de sa création. 2- Quel est le principal intérêt de créer une SCI familiale? La SCI familiale permet notamment d’acheter et/ou de conserver un bien immobilier entre membres de la même famille. Ce bien peut être mis à la disposition de la famille, loué, ou encore vendu. Attention : chaque héritier doit bien comprendre que le bien ne lui appartient plus mais appartient collectivement à la SCI, avec un pourcentage bien défini pour chacun ou chacune. La SCI familiale présente plusieurs avantages. Pour un couple, c’est une opportunité pour faciliter la constitution d’un patrimoine et la transmission d’un bien immobilier. La donation entre époux sera moins taxée dans le cadre d’une SCI, les droits de succession moins élevés. Pour vos enfants, la SCI permet de leur constituer un patrimoine sans qu’ils aient à y verser de l’argent. Les coûts de succession là aussi seront réduits. La SCI évite en outre la dispersion du patrimoine. La SCI implique que les associés participent ensemble à la gestion du bien immobilier. Pour maintenir les bonnes relations entre les membres de la famille, les modalités de fonctionnement doivent être très clairement définies. Vous devez accorder une grande importance à la rédaction des statuts, véritable colonne vertébrale de la société. 3- Quelles sont les règles de l’art pour créer une SCI ? La rédaction des statuts est fondamentale et des éléments incontournables doivent y figurer comme : les apports des associés, les conditions de vente ou de transfert des parts de chaque associé, les modalités de modification des statuts, l’organisation des différents événements comme les assemblées générales, les règles de majorité des votes, qu’il est possible de limiter aux seuls parents. Vous devez également désigner le gérant de la SCI qui dirigera la société dans la limite des pouvoirs prévus dans les statuts et procéder à l’immatriculation de la société au registre du commerce et des sociétés auprès du greffe du tribunal de commerce. 4- Quelles sont les principales erreurs à ne pas commettre afin de sécuriser la SCI ? Lors de la rédaction des statuts, faites attention à la définition de l’objet social, c’est-à-dire l’ensemble des activités que la société entend exercer. Si les statuts ne prévoient pas que le bien peut être vendu ou loué et dans quelles conditions, cela risque de limiter voire d’empêcher le fonctionnement de la société et ainsi être source de tensions au sein de la famille. Prévoyez un objet social le plus large possible, qui recouvre tous les actes concernant l’acquisition, la détention, la location et la vente du bien immobilier. Pensez également que la vie de la SCI ne tourne pas uniquement autour des immeubles. On peut en effet avoir besoin de souscrire un emprunt, ou ouvrir un compte bancaire. Tout ceci doit être inscrit dans les statuts.

En effet, la Société Civile Immobilière offre énormément d'avantages mais nombreux sont ceux qui oublient son coté plus ou moins sombre. Découvrez les 6 pièges de la SCI que beaucoup d'investisseurs ignorent. 1. Impossible de faire une location meublée. Evidemment lorsqu'on est en SCI à l'IR il n'est pas possible de faire une location meublée. Cela peut se faire seulement si c'est considéré à la marge par l'administration fiscale. 2. Le coût. Pour avoir des statuts qui sont bien rédigés, en fonction de ses besoins, il va falloir passer par les notaires ou des avocats. Et c'est bien entendu des coûts énormes. 3. La gestion. Dans ce type d'investissement, il y a beaucoup de contraintes administratives. La société peut être qualifié de fictive si il y a un non respect de ces contraintes. Vous perdrez donc l'avantage de détenir une SCI. 4. Tout faire soi-même. L'un des pièges les plus fréquent dans la SCI, c'est de vouloir tout faire soi-même. En faisant cela, vous risquez d'avoir des statuts qui ne seront pas adaptés à votre situation. Prenez conseil chez le notaire afin d'éviter de faire n'importe quoi. 5. Être responsable de manière indéfinie. C'est à dire qu'il faut avoir une responsabilité illimitée sur les dettes. 6. Une SCI par bien ou pour plusieurs biens. Pour l'aspect fiscal, il faut toujours faire une prévision. Et ce que je recommande dans ce cas, c'est SCI à l'IS. Et d'un autre coté la transmission. C'est à dire qu'il est beaucoup plus facile de vendre une SCI. Though the giant bodies in outer space that we would eventually call galaxies were first noticed by French astronomer Charles Messier in the 17th Century, Edwin Hubble, in 1923, was the first to realize what they actually were. It turned out that there were countless galaxies in our universe, made up of billions upon billions of stars and trillions of planets. It did not take humans long at all to do what we do best, imagine. If there were trillions of planets throughout the vastness of space. Could there be another world like ours, with sentient beings like us? From that point onward we began to see aliens everywhere. It has been said that the oldest fear is the fear of the unknown. The fear of the unknown stands at the root of some of our greatest horror stories. Infamous but brilliant writer HP Lovecraft has influenced the entire horror genre, his work speaks because it reflects his genuine fear of the unknown and of the other. The fear of the other is at the root of our fear of aliens. Aliens are scary because we don’t know them, we cannot predict their behavior, they could be cruel, they could see us as bugs beneath them, they could enslave us, steal our world's resources, and then discard us. They could in essence do to us what we do to each other, or perhaps even worse. Infinite terrors await within the unknown. We peer into the darkness of space and yet we do not know what might be peering back or what it might be capable of.
